JOHANNESBURG – Johannesburg Mayor Herman Mashaba said he personally does not think it is necessary for South Africa to apologise to other African countries for the recent xenophobic attacks.
President Cyril Ramaphosa issued an apology at former Zimbabwean president Robert Mugabe’s funeral in Harare.
Last week, Energy Minister Jeff Radebe also apologised on behalf of the president to Nigerian President Muhammadu Buhari.
“Personally, as Herman Mashaba I see no reason why I have to apologise, in fact for me as Herman Mashaba, I believe that a lot of people who have an agenda to collapse this country should apologize to me.”
“They have to apologize to millions of girls who are turned into prostitutes by international drug syndicates”, said Mashaba.
Mashaba says African nationals are not solely responsible for the immigration issues in the country.
“We are not only sitting with problems of immigration from Africans, I have given you an example of someone from the Czech Republic, we also have Afghanis, Pakistanis, how many Pakistanis are in this country illegally?”, added Mashaba.
Sindi grew up in Pietermaritzburg, Kwazulu Natal and was raised in Azalea close to Imbali. Sindi began her musical journey at the age of 12, singing in church with her brothers and sisters.
In the year 2010 she joined a gospel choir called Chosen in Pietermaritzburg, this exposed her to meeting members of an accappella gospel group called AVODAH which she joined in 2011 and sang alongside Nondumiso Radebe. At age 15 Sindi was introduced by Dumi Mkokstad to join the local church and has since had the opportunity to fully grow her career in music by backing artists like Dr Tumi, Hlengiwe Mhlaba, Nathi and Nkanyiso Ayanda Ntanzi, Lebo Segobela, Mahalia, Thobekile and Women in praise.
Sindi studied communications than went to Bible College and studied Theology full-time for 2 years, after which she volunteered as a Communications and Admin person at the local church which gave her depth in the way she uniquely ministers through song.
One of the highlights in Sindi’s musical journey was being in the top 8 of X Factor with the group Avodah in 2014 and when she sang and recorded live with the EThekwini Gospel choir leading a song called Izwi Lakho written and produced by Ntokozo Ngongoma. She is still rooted in her local church as an active Worshiper, now her album, NGAMBONA, which was released in June 2019.

This document sets out general issues related to the Hero Networks24 Inc. Internet service and contains the Hero Networks24 Inc. Internet Acceptable Use Policy (AUP).
Your Hero Networks24 Inc. Internet account provides you access to a vast collection of networks around the world via the World Wide Web, electronic mail, and File Transfer Protocol (FTP). Your use of these services is subject to the AUP.
It is our intention to allow Hero Networks24 Inc customers access to everything the internet has to offer, with minimal or no interference. Our belief in free speech is a firm commitment to our customers. However, certain activities are considered inappropriate by the internet community at large and cannot be permitted under the guise of free speech.
Save as may be set out herein, we do not monitor the activity of accounts, except for measurements of system utilization and billing records. However, in our efforts to promote good citizenship within the Internet community, if we become aware of inappropriate use of our service, we will respond appropriately.
If a Hero Networks24 Inc. Internet account is used in a manner which violates this AUP, we reserve the right to terminate the service without notice. Our preferred course of action is to advise you of the inappropriate behavior and any corrective action that is necessary. 2. Protecting Your Account
It is your responsibility to keep your password secure and not to share your password and account access with anyone. Attempting to obtain another user’s account information is strictly prohibited, and may result in termination of service.
3 . Account and Network Security
It is also your responsibility to implement security measures, including but not limited to the following
- changing your internet account password regularly;
- changing your router default password regularly;
- installing licensed internet security software, which includes, but are not limited to protection against internet threats such as viruses, malicious software, spy-ware, hacking attempts, etcetera; and
- Monitoring your internet account for
You may not:
- Attempt to circumvent the user authentication or security of any host, network or account (“cracking”). This includes, but is not limited to, accessing making use of a server or account you are not expressly authorized to access, or probing the security of other networks;
- Use or distribute tools designed for compromising security. Examples of these tools include, but are not limited to, password guessing programs, cracking tools or network probing tools; or
- Attempt to interfere with service to any user, host, or network (“denial of service attacks”). This includes, but is not limited to “flooding” of networks, deliberate attempts to overload a service, and attempts to “crash” a
4. Electronic Mail
Your account with Hero Networks24 Inc Internet includes the ability to send and receive electronic mail. Misuse of e-mail may result in termination of service. The following examples are non-exclusive and are provided for guidance to customers:
- Use of an e-mail account to send an unsolicited bulk or commercial message is prohibited on your Hero Networks24 Inc Internet account. This includes, but is not limited to, bulk-mailing of commercial advertising, informational announcements, charity requests, petitions for signatures, and political or religious tracts. Such material may only be sent to those who have explicitly requested it;
- sending mass unsolicited mail or deliberately sending very large messages or files to one or more recipients (“mail bombing”) is prohibited;
- forging or removing e-mail headers is prohibited;
- Use of e-mail to harass or intimidate other users is prohibited. Harassment, whether through language, frequency of messages, or size of messages, is prohibited. Sending a single unwelcome message may be considered harassment. If a recipient asks to stop receiving e-mail from you, you must not send that person any further messages; and
- Hero Networks24 Inc Internet accounts may not be used to collect replies to messages sent from another ISP, where those messages violate this AUP or the AUP of the other ISP. Hero Networks24 Inc reserves the right to delete messages or files which have remained on its servers for excessive periods of time as determined by Hero Networks24 Inc, in its sole
5. Protection of Network Performance
Hero Networks24 Inc reserves sole discretion to determine whether any customer’s use of the Hero Networks24 Inc Internet service interferes with other customers’ use and enjoyment of any services provided by Hero Networks24 Inc to customers over the same network.
The following examples are non-exclusive and are provided for guidance to customers:
- the sending of excessive numbers of e-mail or excessively large files which, in Hero Networks24 Inc ‘s sole opinion, negatively affects the performance of the network or any server on the network may result in deletion of the offending message or file, and may result in the termination of services;
- you may not provide network services from your account (for example, you may not use your account to operate as an FTP server);
- Hero Networks24 Inc Internet accounts operate on shared resources. You are prohibited from excessive consumption of resources, including central processing unit time, memory, disk space and session time. You may not use resource-intensive programs which negatively impact other customers or the performance of Hero Networks24 Inc Hero Networks24 Inc systems or networks. Hero Networks24 Inc reserves the right to terminate or limit such activities; and
- You may not employ automated electronic or mechanical processes designed to defeat network inactivity time-outs. Such tools include, but are not limited to, repetitive pinging the host.
6. Personal Home Pages
Your Hero Networks24 Inc Internet account provides the option to purchase personal home page space. Hero Networks24 Inc Internet will routinely monitor the size your personal web page and may, from time to time, monitor the contents of your personal web page.
You are solely responsible for any information contained on your personal home page. However, if complaints are received regarding language, content or graphics contained on a customer’s personal home page, Hero Networks24 Inc
Internet may, at its sole discretion, remove the personal home page and / or terminate your personal home page service.
You may not use your personal home page to publish material which Hero Networks24 Inc determines, at its sole discretion, to be unlawful, indecent or objectionable.
- For purposes of this AUP, “material” refers to all forms of communications including narrative descriptions, graphics (including photographs, illustrations, images, drawings, logos), executable programs, video recordings, and audio
- “Unlawful content” is that which violates any law, statute, treaty, regulation, or lawful order. This includes, but is not limited to obscene material, defamatory, fraudulent or deceptive statements, threatening, intimidating or harassing statements, or material which violates the privacy rights or property rights of others (e.g. copyright or trademarks).
- “Indecent content” is that which depicts sexual or excretory activities in a patently offensive matter as measured by contemporary community
- “Objectionable content” is otherwise legal content with which Hero Networks24 Inc concludes, in its sole discretion, it does not want to be associated with in order to protect its reputation and brand image, or to protect its employees, shareholders and

- materials which encourage the commission of a crime, or which tends to incite violence, or which tends to degrade any person or group based on sex, nationality, religion, color, age, marital status, sexual orientation, disability or political
7. Third Party Internet Relay Chat (IRC)
Although Hero Networks24 Inc may offer IRC software, you may not:
- use IRC scripts or programs that interfere with or deny service to other users on any other server or host; or
- engage in activities that harass other users. This includes, but is not limited to, “flooding” (rapidly entering text with the intent to disrupt service), “flashing” (disrupting terminal emulation), “takeovers” (improper seizing and abuse of operator privileges), attempting to send private messages to those who do not wish to receive them, attempting to return to a channel after being banned from it, and other disruptive

8. Illegal Activities
Any activity on Hero Networks24 Inc’s network that is a violation of any law, regulation or this policy, as such may be in force from time to time, may result in immediate termination of service without notice to you.
It is also your responsibility to ensure that you are aware, stay aware of, and shall at all times comply with, all statutory or other regulatory provisions and rules applicable to the provision and use of the Hero Networks24 Inc Internet service as amended from time to time, including but not limited to the provisions of the Electronic Communications and Transactions Act 25 of 2002, the Films and Publications Act 65 of 1996 and the Regulation of Interception of Communications and Provision of Communication-Related Information Act 70 of 2002.
Prohibited activities include, but are not limited to:
- transmitting obscene materials, including child pornography or any material regarded as illegal;
- intentionally spreading or threatening to spread computer viruses;
- gaining or attempting to gain unauthorized access to private networks including Hero Networks24 Inc’s private network infrastructure;
- accessing or attempting to access information not intended for the customer;
- engaging in the transmission of pirated software;
- conducting or participating in illegal gambling, soliciting for illegal pyramid and other schemes through electronic mail; or
- Any other activities declared to be illegal in terms of any applicable.
9. Hero Networks24 Inc Internet Uncapped Fair Usage Policy
Hero Networks24 Inc Internet uncapped accounts are designed for either home or business use, and customers need to select the appropriate package designed for their access port speed and type of usage application (for example, for business or home use).
Hero Networks24 Inc Internet uncapped products are not capped in the ordinary course. However, Hero Networks24 Inc reserves the right to apply restrictions on an uncapped account if a customer’s behavior is determined to be affecting the user experience of other customers on Hero Networks24 Inc’s network. Such restrictions may include but are not limited to throttling a customer’s throughput speeds to an appropriate proportion of the actual port speed and / or shaping a customer’s bandwidth to limit the use of bandwidth intensive protocols and applications.
Examples of customer behavior which may compromise Hero Networks24 Inc’s network performance include, for example, causing network congestion, include running excessive concurrent internet sessions or accessing excessive bandwidth intensive protocols such as peer-to-peer.
In the event of such behaviors, Hero Networks24 Inc reserves the right to terminate the account of a customer whose usage is continuously affecting Hero Networks24 Inc’s network performance, as a customer of Hero Networks24 Inc Internet uncapped products.
In order to assist a customer to be made aware of when his or her behavior is compromising Hero Networks24 Inc’s network performance, Hero Networks24 Inc has a Dynamic Fair Usage Policy that indicates usage severity levels. Customers will be allocated randomly to three different rolling window dates of 8th, 15th and 21st. These dates are applicable from one month to the same date of the following month and defines the monitoring window. Usage values and thresholds will be displayed with customer notification messages. In browser notification and notification messages can be deselected by customers on the usage portal. Should customers’ contact information not be registered correctly, such notification may not reach the customer and customers should ensure that contact information is always up to date.
The Fair Usage Policy (FUP) controls will be implemented by Hero Networks24 Inc in addition to those set out elsewhere in this AUP regarding unlawful behavior.
Different severity FUP levels and actions are defined for Uncapped usage volumes:
- FUP Level 1 for customers which are at 50% of predefined usage
- FUP Level 2 for customers which are at 75% of predefined usage
- FUP Level 3 for customers which are at 100% of predefined usage volume. Access to hero24.org and Banking sites will not be throttled at any
The following actions are applicable on the various FUP levels:
- FUP Level 1 (50% of quota value)
The customer will be throttled to approximately 50% of their product speed for the 2 hours of highest demand daily until rollover.
- FUP Level 2 (75% of quota value)
The customer will be throttled to approximately 25% of their product speed for the 4 hours of highest demand daily until rollover.
- FUP Level 3 (100% of quota value).
The customer will be throttled to an 8th of their product speed or 384 kbps (whichever is higher) until the following rollover date, except during NightSurfer (00h00 to 07h00)
The new cycle date will be selected randomly once level 3 is reached and acknowledgement is accepted on the Hero Networks24 Inc Internet portal. The applicable date period for roll-over will be displayed.
10. Breach of the Acceptable Use Policy
In general, if you use your Hero Networks24 Inc Internet account in a manner which:
- violates rules, regulations and policies applicable to any network, server, computer database, website or Internet Service Provider (“ISP”) that you access through your internet account;
- violates any law, regulation, treaty or tariff,
- is defamatory, fraudulent, indecent, offensive, deceptive; or threatens, harasses, abuses or intimidates others;
- damages the name or reputation of Hero Networks24 Inc, its holding company, affiliates and subsidiaries;
- interferes with other customers’ use and enjoyment of the services provided by Hero Networks24 Inc; or
- breaches the security on any computer network; or
- to access an account which does not belong to you; it will be regarded as a breach of this
In the event of breaches of this AUP, Hero Networks24 Inc will, where circumstances allow, provide notice of the breach to the relevant user with a request to remedy same immediately, failing which the relevant customer’s account may be terminated. However, where the circumstances warrant it, Hero Networks24 Inc may terminate a customer’s account without notice.
In addition to the above, users who violate systems or network security may incur criminal or civil liability. Hero Networks24 Inc will co-operate fully with investigations of violations of systems or network security at other sites, including co-operating with law enforcement authorities in the investigation of suspected criminal violations.
Hero Networks24 Inc’s failure to enforce this policy, for whatever reason, shall not be construed as a waiver of Hero Networks24 Inc’s right to do so at any time.
Hero Networks24 Inc reserves the right to amend this AUP from time to time.
V&A desalination debacle: Seawater 400% more polluted than City’s tender data indicated

The seawater feeding into the desalination plant at the V&A Waterfront is polluted by raw sewage from the Green Point outfall pipe and is sometimes up to 400% dirtier than specifications the City gave companies that tendered to build the plant.
This is according to Musa Ndlovu, director of Quality Filtrations Systems (QFS), the company that was awarded the contract to build the temporary desalination plant in January last year, when Cape Town was facing the prospect of taps running dry on Day Zero in early April.
Ndlovu said once they had found out about the high level of pollution, it had cost them millions to modify the plant to deal with it.
“The City gave us tender data about the feedwater – everyone that tendered had to work off the same data, not do their own tests – and we designed a plant accordingly. Then when we did tests during commissioning of the plant, we found contaminants that were not in the tender data,” Ndlovu said.
They warned the City, and then spent an additional R7m on installing extra equipment to ensure that the two million litres it produced every day met the national drinking water standards.
Breach of contract
This is one of several areas of dispute between the City of Cape Town and QFS, which has terminated its contract with the City and is now suing the City for R80m for breach of contract and for damages.
In its defence, the City has said a requirement in the tender was that the desalination plant had to be able “to cope with varying sea water quality conditions” likely to be found at the site close to the harbour entrance.
Ndlovu said desalination plants could handle normal variation in seawater quality, which was around 10%. To be on the safe side, the company had opted to build a plant that could cope with 30% variation of the seawater quality data the City had given them.
“But 400% is abnormal. We realised the variation was caused mainly by raw sewage – which the City itself puts into the sea. They didn’t disclose that in the tender specification data, otherwise we would have designed a plant fit for that purpose,” she said.
QFS has expertise in treating water contaminated with sewage: In 2010, it built South Africa’s first direct reclamation plant in drought-stricken Beaufort West, producing 2.3 million litres of drinking water from sewage effluent every day.
Ndlovu said QFS later found out that Leslie Petrik, a professor of chemistry at UWC, had written to the City in September 2017 to say the tender specifications were inadequate to produce safe drinking water, given the proximity to the Green Point sewage outfall pipe and the type of desalination plant specified by the City.
“She warned the City that the tender data excluded sewage contamination, but the City issued the tender in November without this data.”
On March 13 last year, the company’s desalination plant, complete with modifications to deal with the sewage-contaminated water, was ready.
The water it produced was tested by the City’s scientific services and by an independent laboratory, and was found to meet the SA National Standards (SANS) 241 for drinking water quality.
But then nothing happened.
Although Cape Town was still facing Day Zero, and the mid-March dam levels had sunk to 22% of storage capacity, and each Capetonian was restricted to only 50 litres of water a day, the City did not give the company the go-ahead to feed the 2 million litres a day of desalinated water into the system.
QFS wrote to the City several times asking for the go-ahead.
Instead, on March 29, the City’s water and sanitation department issued an instruction to QFS that it had to do a whole range of further lab tests, including tests for sewage contamination, as a “raw water baseline risk assessment requirement”.
The City offered to pay for the extra tests, because it had not been part of the initial requirement, but later said it would not pay.
“It was never a requirement for us to treat sewage contaminants. We had to spend our capital on treating the 400% abnormal feed water variation. Our plant always produced compliant water. They City has never questioned that. The City however decided not to compensate us for our plant upgrade and the high operating cost caused by them dumping sewage into the ocean,” Ndlovu said.
The City eventually gave permission for QFS to inject the desalinated water into the system on May 28 – but only 25% of the 2 million litres.
On September 4, six months after the plant was built and ready, the City finally give permission to inject the full 2 million litres a day into the system.
QFS managing director Herman Smit said the list of additional pollutants the City had told the company to test for was a “full spectrum” sewage analysis.
This proved, he said, that they had known about the sewage contamination.
“This is the only reason they delayed injection into the network. In retrospect they were very scared to accept final water as a result of the raw water sewage contamination, but never divulged knowledge thereof,” Smit said.
The company says the contract stipulates that the City would pay it monthly rental for the availability of the water, whether or not it was buying the water. It says it sent the City invoices for “rental” but these were not paid.
“So many things went wrong. We had five disputes with the City. The contract says if there are disputes the parties must go to mediation. We tried to get the City to go to mediation, but they ignored us. In the end we had to go to the High Court to get an order to force the City to go to mediation,” Ndlovu said.
“And when they arrived, they came with five attorneys and an advocate. From Webber Wentzel. The mediation process was meant to take four days, but it took five months.”
Ndlovu says the City’s advocate conceded in the mediation that it had to pay QFS a monthly rental fee.
QFS wanted a mediation report, but the City said there was to be no report.
“We think they said no mediation report because they knew that it would be evidence.”
Ndlovu said they had been left with no option but to go to court to sue the City for breach of contract for non-payment of rental, and for the extra costs incurred from sewage pollution.
“We are saying to the City: ‘Pay us what you owe us and we will go on our way’.”
Asked to comment on QFS’ claims that the City had made no mention of sewage contamination in the specifications given to companies tendering to build the temporary desalination plant, the City said it rejected any implication that false information had been supplied to anyone “deliberately”.
Councillor Xanthea Limberg, mayoral committee member for water and waste, said the contractor who designed the desalination plant was responsible for “taking cognisance of normal variations in water quality” and for building a plant “robust enough to accommodate raw water quality during all seasonal variations”.
She did not stipulate the percentage of variation the City regarded as “normal”.
Limberg said the seawater data in the tender documentation was from seawater analyses done in September 2017.
“Small areas of the coastal water around Cape Town are contaminated by various pollutants. This is variable and often seasonal.”
This was normal for any city, she said. Sources of contamination were vast and included “urban run-off, household discharge, stormwater discharge, treated effluent discharge from our wastewater works, various marine outfalls, urban litter, etc”.
Limberg said the seawater was tested monthly around the sewage outfalls, and every two weeks at bathing beaches.
She maintains the contract with QFS did not include monthly rental payment.
“QFS was responsible for the cost of establishing the plant, which cost would have been recovered by QFS through the sale of water to the City,” Limberg said.
Ndlovu said the company was disappointed with the City, which had a good reputation, and they had never thought their money might be at risk with a City of Cape Town contract.
“We are trying to understand it. There must be something big behind this. We heard that the V&A desalination plant was Patricia de Lille’s baby. There have been a lot of political wars, and maybe they’re trying to kill it off – but that can’t be done at the expense of a bona fide company,” Ndlovu said. DM
